I believe that income tax for eBay sales is generally more likely to be enforced if a seller is set up as a "business".  Intermittently selling used items (like electronics, CDs, or books) for less than you paid for them, is not considered a profit, so it's generally not taxable income.  A lot of it is still pretty vague, and probably subject to change; there is some more info on this IRS page.  Even eBay is pretty vague about it.

I've been looking into liquidating some superfluous flotsam and jetsam. I was beyond shocked to find out income from items sold on Ebay is taxable.

 I think if you legally own it,you should be able to sell it without being penalized.

 I can see taxing antique dealers and such,but getting taxed for selling your childhood Mickey Mantle baseball card or Grandma's tortoise shell hairpin?{#Rolleyes}

And it's a fundamentally messed up idea. The point of taxes is that they are in support of something. Sales taxes support the infrastructure that supports those sales - police for a safe shopping environment, local government for traffic control and development standards, ect. Internet sales use none of these things and the infrastructure they do use is already supported by other taxes - gas taxes for delivery, B&O taxes for the delivery, warehouse and fulfillment companies, utility taxes for the communications portion of the deal.  Are the beneficiaries of this tax doing anything to support the commerce that generates it?  This is just a grab by cash strapped states because they see their retail tax revenue declining. In the end it will just wind up as another .gov enforced subsidy to states and will simply shift the true costs around to places it is less apparent. Regardless of who benefits in the end it's not a good idea.

Finally did my income tax today. The sun was pretty hot in the living room, so i had to shade my beer with a box of cereal. Went from owing the Gov close to $1,000 to getting back a refund close to $500 to getting back a refund close to $1,500. I love making mistakes in my favor. {#Cheers} But i think it has to do with the beer. Beer always brings me good luck. I should be allowed to drink and drive for that reason alone. {#Shifty}
