Judge cuts $2M penalty in MN song-sharing case

MINNEAPOLIS (AP) — A federal judge on Friday drastically reduced a nearly $2 million verdict against a Minnesota woman found guilty last year of sharing 24 songs over the Internet, calling the jury's penalty "monstrous and shocking."

U.S. District Judge Michael Davis reduced the $1.92 million penalty a jury imposed against Jammie Thomas-Rasset of Brainerd to $2,250 per song, or about $54,000.

"The need for deterrence cannot justify a $2 million verdict for stealing and illegally distributing 24 songs for the sole purpose of obtaining free music," Davis wrote.

Davis also denied Thomas-Rasset's request for a new trial. He gave the Recording Industry Association of America seven days to either accept the smaller penalty or to ask for another trial to set new damages.

Cara Duckworth, spokeswoman for the RIAA, said the group's attorneys were still analyzing the ruling and would have no immediate comment.

Reached on her cell phone, Thomas-Rasset said the ruling was positive but that her attorneys are planning an attempt to get it lowered further. "Whether it's $2 million or $54,000, I'm a mom with four kids and one income and we're not exactly rolling in that kind of dough right now," she said.

Kiwi Camara, one of Thomas-Rasset's attorneys, said he was pleased with Davis' decision. Now, he said, the only question is whether the remaining damages are constitutional - an issue he could appeal to the 8th Circuit.

This case was the only one of more than 30,000 similar lawsuits to make it all the way to trial. The vast majority of people targeted by the music industry had settled for about $3,500 each. The recording industry has said it stopped filing such lawsuits and is instead working with Internet service providers to fight the worst offenders.

Under federal law, the recording companies are entitled to $750 to $30,000 per illegally downloaded song - but the law allows the jury to raise that to as much as $150,000 per track if it finds the infringements were willful.

New rate for music digital stream

The music collection society - PRS - have unveiled a new pricing plan it hopes may entice YouTube and Pandora back to the UK market.

From 1 July 2009, firms will have to pay 0.085p for each track streamed, down from the previous rate of 0.22p.

Yesterday, Congressman Jay Inslee, and several co-sponsors, introduced legislation to give us the extra time we need but the National Association of Broadcasters (NAB), which represents radio broadcasters such as Clear Channel, has begun intensively pressuring lawmakers to kill the bill. We have just days to keep this from collapsing.

This is a blatant attempt by large radio companies to suffocate the webcasting industry that is just beginning to offer an alternative to their monopoly of the airwaves.

Please call your Congressperson right now and ask them to support H.R. 7084, the Webcaster Settlement Act of 2008 - and to not capitulate to pressure from the NAB. Congress is currently working extended hours, so even calls this evening and over the weekend should get answered.

yeah...I will be on the phone this week to my congressman..but the RIAA and Soundexchange...really need to loosen up...these people are so tight...they can fart out diamonds....you would think they would cash them in and leave the rest of us alone....I have hard time believing that by restricting net radio, music companies will increase their profits....I was at a party in manahattan and ran into two industry lawyers who really believe this....I said you have to be kidding...when napster was up, my wife and I where spending 300 a month on music...now I got research what I hear and make sure it's not RIAA sponsored...and trust I am not the only middle professional who is buying music this way....sorry for the rant...but I am sick of this...

I thought we had this beat as well. I just sent a note to Tim Westergren, Founder of Pandora, to see if there is anything we can do. Yes, I've written the emails to Congress and called them as well as Senators....in Spring of 2007. Will that even make a difference. Is there a specific "ask" we should be requesting? And I guess I have a similar question for BillG. Is RP set in this area, or not? We could use an update. Thanks for posting the Washington Post article link to the RP community, chance4phun. It is a very well written article.

We all know of the confiscatory royalty rates demanded by the record companies, we all know of the money threat hanging over places like RP and others like it.

A caller to Rush Limbaugh's show on May 30, 2008, asked why there is no music, no parodies on the MP3 downloads you can stick on your iPod. After he said it's because his EIB Network does not have permission to podcast tunes, parody or otherwise, he says this:

"...And written lyrics, and we do not pay a license fee for that. In fact, we here at the EIB Network, I think we pay a little bit of a license fee to BMI and ASCAP, but our affiliate stations are the ones that actually have to pay for the privilege of broadcasting published music. And there has not been a deal -- well, there has been a deal struck for Internet delivery, and it's outrageously expensive. With the number of podcasts that we have and the number of users, I mean we'd have to raise the membership, the subscriber rate on the website to a level that would make no sense. These copyright people are trying to get even tougher now. Radio stations pay a license fee. It's not really much. They are now being hit with the possibility that they're going to have to start paying through the nose to play music. I don't know where it stands now, but there's a lot of controversy about it. It's a federal issue at some level. But that's the reason. I'm glad you called and asked because people think we're screwing up when we do not put any music on the podcasts, including the parodies. It's simply we don't have permission. We haven't struck a deal to pay for it, it's just outrageous. It's so outrageous the people who own the music are screwing themselves by seeing to it that their work is not exposed. So it's just the way it is.

It's like when the government runs things; when the subway ridership goes down, they raise fares. In the private sector, you lower fares, lower prices to increase volume. And these clowns on the other side of this are just doing it the wrong way. We're always looking for other ways to do it 'cause look, this is Excellence in Broadcasting Network, and as a highly trained specialist it does not satisfy me to have to send this program out podcast-wise without any of the audio in it in terms of the music because the music is a significant part of the program. So we're always working on it, but, you know, look, people that I've hired to run this thing, they are paranoid. I will admit, I've tried to sneak a couple things in that I thought were so good, "Just do it! What are the odds we're going to get caught?" "If we get caught, Rush, you don't want to deal with what will happen." "Okay, okay, okay." I've tried to sneak it by 'em, but they just will not. "Can't we just say it was a mistake; that Brian screwed up and forgot?" "No. You can't do that." "Well, what are the odds we're going to get caught?" "They're really small, but, Rush, you don't want that circumstance." These people are pretty serious about them not being compensated when their stuff is used, and I understand it, in a sense, it's just their pricing is out of control, makes no sense."


Not even the mighty Rush can escape the record companies and I agree that all they are doing is preventing their music from being heard.
